No. The O-1 is not about fame. It is about demonstrating that you have risen to the top of your field through sustained achievement. Many successful O-1 applicants are well-known within their industry but not household names.
How many of the 8 criteria do I need to meet?
You need to demonstrate at least 3 of the 8 criteria. However, quality matters more than quantity. Strong evidence for 3 criteria is better than weak evidence across 6.
Can startup founders qualify for an O-1?
Yes. Founders regularly qualify by demonstrating original contributions (their product or technology), high compensation (equity valuations count), press coverage, and critical roles at distinguished organizations (including their own funded startups).
How long does the O-1 process take?
With premium processing, USCIS adjudicates within 15 business days. The overall timeline depends on how long it takes to build your petition. Most cases take 2 to 4 weeks for preparation, plus processing time.
Can I change employers on an O-1?
Yes, but a new petition must be filed by the new employer or agent. You can begin working for the new employer as soon as the new petition is filed, without waiting for approval, thanks to portability provisions.
